These Terms & Conditions (« Terms ») govern all bookings and participation in activities, experiences, and stays provided by Agafay Adventure Tours (« we », « us », « our »). By booking with us or taking part in any of our activities, you (« you », « the client », « the participant ») confirm that you have read, understood, and accepted these Terms.

1. Booking and Confirmation

Bookings can be made via WhatsApp at +212 661 887 020, through our website, or in person. A booking is only confirmed once we have acknowledged it and any required deposit or payment has been received. You are responsible for providing accurate booking details, including the number of participants, date, time, and contact information.

2. Prices and Payment

All prices are displayed in Moroccan dirham (dh / MAD). Prices and availability may change without notice until a booking is confirmed. Activity prices (for example, Quad Adventure from 250 dh or Camel Ride from 150 dh) are generally per person, while tent stays are priced per stay.

A deposit may be required to secure your booking. (State your deposit amount or percentage.)
The remaining balance is due (state when — e.g. on arrival, before the activity begins).
Accepted payment methods are (list: cash in dirhams, card, bank transfer, online payment).

3. Cancellation and Refunds

Cancellation by you: If you need to cancel or reschedule, please notify us as early as possible. Refunds depend on how much notice you give:

Cancellation more than (X hours/days) before the activity: (full refund / refund minus deposit).
Cancellation less than (X hours/days) before the activity: (partial refund / no refund).
No-shows or late arrivals that miss the activity: (no refund).

Cancellation by us: In rare cases we may cancel an activity for safety, weather, or operational reasons. In such cases we will offer you a reschedule or a full refund of amounts paid for the affected activity. We are not responsible for other costs you may incur, such as transport or accommodation.

4. Changes to Your Booking

We will do our best to accommodate changes to your booking, subject to availability. Changes requested close to the activity date may not be possible.

5. Weather and Operating Conditions

Our activities take place outdoors in a desert environment. Extreme heat, storms, or other conditions may require us to delay, shorten, or cancel an activity for your safety. Where an activity is cancelled by us due to weather, the cancellation terms in Section 3 apply.

6. Participant Requirements

To take part in certain activities, you must meet the following requirements:

Minimum age for driving a quad or buggy: (state age). Younger guests may participate as passengers where permitted. (State your rules.)
You must be in suitable physical condition and free of any medical condition that could make participation unsafe.
You must not take part in motorised or riding activities while under the influence of alcohol, drugs, or any substance affecting your ability to participate safely.
Pregnant women and people with heart conditions, back problems, or other relevant conditions should not take part in high-impact activities. If in doubt, consult a doctor before booking.

You agree to disclose any relevant medical conditions before the activity begins.

7. Safety and Conduct

Your safety is our priority. You agree to:

Attend and follow the safety briefing before any motorised activity.
Wear the safety equipment we provide, including helmets where applicable.
Follow the instructions of our guides at all times.
Drive or ride responsibly, within the routes and speed limits indicated.
Treat animals, equipment, staff, and other participants with respect.

We reserve the right to refuse or stop participation, without refund, if a participant behaves in a way that is unsafe, reckless, or disruptive, or is under the influence of alcohol or drugs.

8. Assumption of Risk

Adventure activities such as quad biking, buggy riding, camel rides, and horse rides involve inherent risks, including the risk of injury. By participating, you acknowledge and voluntarily accept these risks. You agree to follow all safety instructions and to participate within your own ability and comfort level.

9. Liability

To the maximum extent permitted by applicable law, we are not liable for injury, loss, or damage resulting from your failure to follow safety instructions, your misuse of equipment, or risks inherent in the activities. Nothing in these Terms excludes liability that cannot be excluded under Moroccan law. (This section should be reviewed by a qualified lawyer.)

10. Insurance

We strongly recommend that all participants hold valid travel and personal accident insurance covering adventure activities. (State what, if any, insurance you provide.)

11. Damage to Equipment

You are responsible for any loss or damage you cause to our vehicles, equipment, or property through negligence, misuse, or failure to follow instructions, and you agree to cover the reasonable cost of repair or replacement.

12. Overnight Stays

For tent stays, check-in and check-out times, included services, and camp rules will be confirmed at the time of booking. Guests are expected to respect the camp, the environment, other guests, and quiet hours. (Add your check-in/out times and camp policies.)

13. Personal Belongings

You are responsible for your personal belongings during your visit. We are not liable for loss, theft, or damage to personal items, including valuables, electronics, and cameras.

14. Photography and Media

We may take photos or videos during activities for promotional purposes. If you do not wish to appear in our media, please let us know in advance and we will respect your request.

15. Force Majeure

We are not responsible for failure to perform our obligations due to events beyond our reasonable control, including natural disasters, extreme weather, strikes, accidents, or government restrictions.

16. Complaints

If you are not satisfied, please raise the issue with our team during your visit so we can try to resolve it on the spot. You can also contact us afterwards via WhatsApp or email.

17. Privacy

Any personal information you provide is handled in line with our Privacy Policy. (Link to your Privacy Policy page.)

18. Governing Law

These Terms are governed by the laws of the Kingdom of Morocco. Any dispute relating to these Terms or to our activities shall be subject to the competent courts of Marrakech.
